Housing discrimination is illegal under both federal and Colorado law. Everyone has the right to equal access to housing opportunities regardless of certain protected characteristics. If you believe you were treated differently when renting, buying, financing, or applying for housing because of a protected characteristic, help may be available.

Housing Discrimination Help

What is housing discrimination?

Housing discrimination occurs when someone is treated unfairly during the housing process because of characteristics protected by federal, state, or local law. This may occur when searching for a rental home, applying for a mortgage, attempting to purchase property, or accessing housing-related services.

Fair housing laws are designed to ensure that everyone has equal access to housing opportunities and that housing providers follow consistent and nondiscriminatory practices.

Federal & colorado Laws

Protected characteristics under federal law

  • Race
  • Color
  • National origin
  • Religion
  • Sex
  • Disability
  • Familial status (including households with children)

  • Marital status
  • Sexual orientation

Local jurisdictions may also provide additional protections depending on the city or county.

Examples of potential housing discrimination

Discrimination can appear in many ways during the housing search or rental process. Examples may include:

  • Being told different information over the phone than in person, such as different pricing or availability.
  • Being discouraged from living in certain neighborhoods or buildings.
  • Being told a property is unavailable when it is still being advertised.
  • Being asked excessive questions about background, criminal history, or legal status when other applicants are not.
  • Being told “no pets allowed” even when you have a service animal.
  • Being refused accessible parking or reasonable disability accommodations.
  • Being steered toward or away from specific communities.
  • Being told you must live in a certain building or unit because you have children.

Practices that may violate fair housing laws

Examples of actions that may be illegal under fair housing laws include:

  • Refusing to rent, sell, or finance housing
  • Providing different terms, conditions, or privileges
  • Being told a property is unavailable when it is still being advertised.
  • Misrepresenting housing availability
  • Using discriminatory language in advertising
  • Steering renters or buyers toward certain neighborhoods
  • Threatening, intimidating, or retaliating against someone for asserting their housing rights
